Sightseeing and taking pics with her sister, Kim pulled her hair back, leaving all the focus on her tight, red maternity dress. The knee-length dress had thick straps, which offered a great deal of support. It also had extra material around her belly, which?flattered?her growing baby bump.

The dress slimmed down after the belly, which really flaunted her curves in the back!

It?s never a good idea to ?throw the book? at an employee just be??cause a supervisor wants to get rid of her. That?s especially true if it turns out that the supervisor has been making ageist or other offensive comments about the employee and has been making her comply with rules that don?t seem to apply to others.

Before approving discipline, check to make sure this isn?t an illegal effort to terminate. Ask why the supervisor wants to fire the employee.

That?s especially important if she has been doing a good job and received excellent performance reviews in the past. If the supervisor can?t provide a clear performance-based reason or economic argument unrelated to any protected characteristic, press for more information.

Recent case: Sharon, an older woman, worked for U.S. Bancorp until she was terminated for allegedly violating the bank?s so-called zero-tolerance rule against abusing company credit cards. Sharon apparently charged a personal cellphone plan, Internet access and other communications services to her company card.

Sharon sued, alleging that the real reason she was terminated was her age.

She recounted plenty of ageist comments her supervisor had made: that she ?looked ridiculous for her age,? that her clothes were ?inappropriate for her age? and that she wasn?t ?taking care of herself.?

During pretrial discovery, Sharon?s attorney introduced evidence that U.S. Bancorp in fact had no ?zero-tolerance? rule at all. Indeed, other younger employees had charged business suits and other expensive items to their cards with no consequences. Plus, the actual written rule seemed to allow for charging communications technology to the card if employees worked at home and on the road, as Sharon did.

Plus, once the supervisor told Sharon that she couldn?t charge the services, she tried to get them removed from the card but hadn?t completed the process by the time she was terminated.

The court said the combination of evidence?including the ageist statements, the fact that younger employees were retained even when they also appeared to have violated the credit card rules and the fact that Sharon was the only employee terminated for breaking the rule?was enough to send the case to trial. (Brock??bank v. U.S. Bancorp, No. 11-35618, 9th Cir., 2013)

Advice: Could HR have prevented this lawsuit? Yes, by instituting clear guidelines for all discharges.

Insist on an un??biased review of all the stated discharge reasons. Conduct an internal comparison of all past discipline for similar rule violations, including an analysis of how those rules affect protected classes. Interview the affected employee so she can explain her position.

If you see problems with the proposed discharge, consult your attorney. He or she can provide additional advice and may recommend offering a severance package in exchange for a promise not to sue. That can be money well spent. Your lawyer can structure the offer to comply with special rules for older workers so the employee can?t take the money and still sue.

The Microsoft chairman (who is also co-chair of one of the world's biggest charitable organizations)? is no stranger to international travel or meeting heads of state. But, on Monday, when he shook hands with South Korea's first female president, Park Geun-hye, Gates made a serious faux pas, which resulted in a cultural kerfuffle.

Gates shook her hand with just one hand. In South Korea, and much of Asia, that's only done in casual settings, with good friends. To top it off, Gates had his left hand in his pocket, signaling his superiority.

"How rude!" was the response in South Korea media. Almost every news organizations carried the photo on the front page.

The proper way to show respect would have been for Gates to clasp the South Korean leader's hand with both of his hands.

Was Gates sending a blunt signal of political disapproval to the new government leader? Was Gates ignorant of Asian etiquette??

There was enough media buzz that the South Korean president's office felt it needed to issue an official statement on the matter: "Bill Gates took a similar pose for a picture when he met former President Lee Myung-bak five years ago. Just think of it as an American style of greeting," according to Dong.com, the website of Dong-a Ilbo, a leading newspaper in Korea with daily circulation of more than 1.2 million.?

[Editor's note: Since publication, the president's office contacted The Christian Science Monitor to say that it had issued no official statement about the Bill Gates handshake.]

The first part of that statement is true. In fact, the Atlantic Wire compiled a series of Bill Gates One-Hand Shaking, One-Hand-in-Pocket photos from previous meetings with other world dignitaries, including UN Secretary General Ban Ki-moon, China's President Xi Jinping, and French President Nicolas Sarkozy.

Apparently Gates is consistently casual about his handshakes ? with whomever he meets.

While the one-handed Western handshake has become more common in Asia, business etiquette also suggests that one never looks directly in the eyes of the person you're meeting. An exception to that rule is the Philippines. And in many places, a bow is also part of the greeting.

In Cambodia, for example, if you meet a prominent businessman, the proper way to show respect is to place your palms together at chest height and bow at your waist.

There's also a culturally correct way to exchange business cards in Asia, too. Each card should be in English on one side, and the recipient's native language on the other. You present your card with both hands, native language side up and readable to the recipient. When you receive a card, it's also a two-handed affair. Look at it, thank the person, and put in gently in a coat pocket.

Solving the sex abuse crisis: Experts draft a to-do list for Pope Francis

Pope Francis ordered the Vatican this week to act "decisively" in protecting children from sexual abuse and punishing predator priests, but his brief statement contained few specifics on how to stem the crisis that has roiled the Catholic Church for a decade.

The new pontiff directed the Vatican office known as the Congregation for the Doctrine of the Faith to "continue the line" on the anti-abuse policies set by his predecessor, Pope Benedict XVI.

Observers say that to restore the church's credibility and ensure the safety of children worldwide, Francis will have to back up his words with actions. Here they offer some recommendations:

Heads should roll
The pope should demote or discipline a few bishops who were found to have covered up misdeeds, said David Clohessy, executive director of Survivors Network of those Abused by Priests, noting?that Bishop Robert Finn of Kansas City has held onto his diocese even though he was convicted of a misdemeanor for failing to report a pedophile priest.


Although others said the pope was just being polite, Clohessy was incensed that he greeted scandal-scarred Cardinal Bernard Law during the traditional visit to St. Mary Major the day after his election. "Actions speak louder than words," he said.

Name names
"The church needs to be open about the names of offenders who have been found to be abusers," said?Kathleen McChesney, a former FBI official and ex-director of the Office of Child Protection at the U.S. Conference of Catholic Bishops. "If you're a diocese and you know that these 10 clergy members abused children, you should put those on the website."

Church officials may be rightly concerned about the danger of naming a priest who is falsely accused. Thomas Reese, a Jesuit priest and senior fellow at the Woodstock Theological Center, said that to build trust that no coverup is going on, victims' groups should be included in the process of deciding which allegations aren't strong enough to make public.

Meet with victims
The pope has been accused of giving the cold shoulder to abuse victims while he was archbishop of Buenos Aires. Whether that's true or not, he needs to give victims plenty of face time now, Reese said.?

"He has to listen to their stories, reach out to them and apologize -- and do it again and again, and the sooner the better," Reese said. "You don't understand it until you've sat down and talked to these victims. When you hear their stories, it just tears you apart."

Get new advisers
Francis should make sure his inner circle includes people who understand the gravity of the crisis. Thomas Groome, chair of the Department of Religious Education at Boston College, said he hopes the pope recruits Cardinal Sean O'Malley, who had to clean up Law's mess, to assist him in Rome.

The pontiff is less likely to act on Groome's other suggestion: making women, grandmothers in particular, cardinals. He noted that lay cardinals existed centuries ago and that wise old Catholic women with children and grandchildren might bring a new perspective on youth-protection to a church run by childless men.

Crunch the numbers
A decade ago, the U.S. Conference of Catholic Bishops commissioned a survey of every diocese in the country that collected data about the extent of the sex-abuse problem. Even though victims' groups claimed there was under-reporting, McChesney said, "people in the church were stunned at the numbers" -- more than 4,000 priests accused of molesting children.

But predatory priests are not just an American problem. The Vatican should undertake an international survey that would help it identify other regions where abuse is happening, McChesney said.

Shake up the bureaucracy
The Vatican should create a new office in charge of the protection of childen, separate from the Congregation for the Doctrine of the Faith, which would continue to investigate individual abuse claims, McChesney said.

"They have enough on their plate," she said of the CDF, which needs to plow through a large backlog of complaints against priests.

The new office, McChesney said, would serve as a sort of professional board of directors -- helping dioceses across the globe replicate anti-abuse programs that have been successful in the U.S. and making sure the world's bishops and religious communities are complying with Vatican guidelines.

Benedict ordered every diocese in the world to establish policies and procedures to deal with abuse. Two years later, many dioceses have not followed through.

Facebook unveils 'Home' for Android phones

MENLO PARK, Calif. (AP) - With its new "Home" on Android gadgets, Facebook aims to put its social network at the center of people's mobile experiences.

If users choose to download Facebook's Home software starting on April 12, the social network will become the hub of their Android smartphones. A phone from HTC that comes pre-loaded with Home will also be available starting that day, with AT&T Inc. as the carrier.

The idea behind the software is to bring Facebook content right to the home screen, rather than requiring users to check apps. "Home" comes amid rapid growth in the number of people who access Facebook from phones and tablet computers. Of its 1.06 billion monthly users, 680 million log in to Facebook using a mobile gadget.

The service is part of Facebook's move to shift its users' focus from "apps and tasks" to people, said CEO Mark Zuckerberg during Home's unveiling at the company's Menlo Park, Calif., headquarters on Thursday.

The new product, which resides on the home screen of Android phones, is a family of apps designed to help people share things with their Facebook friends. Rather than seeing a set of apps for email, maps and other services when they first turn on their phones, users will be greeted with photos and updates from their Facebook feeds. There will be ads too, eventually.

"We think this is the best version of Facebook there is," Zuckerberg said.

Zuckerberg says users can have an experience on Android phones that they can't have on other platforms. That's because Google makes the software available on an open-source basis, allowing others to adapt it to their needs.

Recognizing that text messaging is one of the most important tasks on a mobile phone, Facebook also showed off a feature called "chat heads." This lets users communicate with their friends directly from their phone's home screen - without opening a separate app.

The move that coincides with rapid growth among the number of users who access the social network from smartphones and tablet computers and Facebook's aim to evolve from its Web-based roots into a "mobile-first" company.

"What Facebook wants is to put itself at the front of the Android user experience for as many Facebook users as possible and make Facebook more elemental to their customers' experience," said Forrester analyst Charles Golvin.

The new Home service won't be available on Apple's iPhone and iPad devices. Apple's iOS and Mac operating systems include features that integrate Facebook's services, but Zuckerberg says doing something like Home would require a closer partnership.

Apple had no immediate comment.

The deeper mobile integration will likely help Facebook to attract more mobile advertisers. Though mobile ads were a big concern for Facebook's investors even before the company's initial public offering last May, some of the worry has subsided as the company muscles its way into the market.

Last year, Facebook began showing ads to its mobile audience by shoehorning corporate-sponsored content into users' news feeds, which also include updates from friends and brands they follow. Facebook now faces the challenge of showing people mobile ads without annoying or alienating them.

The mobile advertising market is growing quickly, thanks in large part to Facebook and Twitter, which also entered the space in 2012. Research firm eMarketer expects U.S. mobile ad spending to grow 77 percent this year to $7.29 billion, from $4.11 billion last year.

EMarketer said Wednesday that it expects Facebook Inc. to reap $965 million in U.S. mobile ad revenue in 2013. That's about 2.5 times the $391 million in 2012, the first year that Facebook started showing mobile ads. Clark Fredricksen, vice president at eMarketer, says "there are some clear reasons why a deeper integration with mobile operating systems and handsets make sense for Facebook. At the end of the day, the more deeply Facebook can engage consumers, no matter what device or operating system or handset," the better.

Facebook's stock rose 80 cents, or 3.1 percent, to $27.05 in afternoon trading following the announcement. It's still 23 percent below its initial public offering price of $35.

Wall Street Week Ahead: Earnings next hurdle for bulls as rally slows

NEW YORK (Reuters) - The stock market's robust rally was slowing even before Friday's jobs report, but the red flag sent up by the weak payrolls data makes the path to more gains less secure.

It means the bulls will have to look to earnings for a way to keep the rally going. The S&P 500 hit an all-time closing high on Tuesday, but lately defensive stocks have been leading the charge, and notable growth indexes are slipping.

This rotation has many thinking the long-awaited market correction is nigh. A 3 percent decline in the Russell 2000 index <.rut> this week seemed to be a confirmation of the trend.

"Momentum I think has been slowing a bit, and it would be interesting to see if this is just a one-session sell-off," said Bruce Zaro, chief technical strategist at Delta Global Asset Management in Boston, about Friday's decline.

In the first quarter, the benchmark's healthcare index <.spxhc> added 15.2 percent and utilities <.splrcu> gained 11.8 percent, besting the broad S&P 500's 10 percent gain.

The transition into defensive stocks may respond to investors' taking into account the effect of higher payroll taxes this year and the $85 billion in government spending cuts that started to trickle at the beginning of the year.

The shift is "a rotation into sectors less affected by a short-term slowdown in the consumer," said Eric Kuby, chief investment officer at North Star Investment Management Corp in Chicago.

EARNINGS HOLD THE KEY

Earnings season starts in earnest next week, with the highlight coming from JPMorgan Chase & Co and Wells Fargo & Co on Friday. Details on Wells Fargo's earnings will be dissected for clues on the health of the housing market.

Overall, S&P 500 earnings are expected to have risen 1.5 percent last quarter, down from a 4.3 percent gain expected at the start of the year, according to Thomson Reuters data.

Investors "are really waiting for the earnings season on balance to disappoint," said Zaro.

Companies have caught up on the lowered expectations, and negative outlooks have been predominant ahead of earnings season. In fact, the negative-to-positive guidance ratio from S&P 500 companies is at its highest since the third quarter of 2001, according to Thomson Reuters data.

At 4.7, the ratio is the sixth-highest among 69 readings dating to 1996.

"Companies understand that since the economy is weak there's no reason to be a hero and give guidance you can't beat," said Nicholas Colas, chief market strategist at the ConvergEx Group in New York.

F5 Networks was the latest and one of the most dramatic examples of lowered earnings expectations. The network equipment maker partly blamed lower government sales for its profit warning late on Thursday, which erased almost a fifth of its market value on Friday.

In past quarters, revenue beats have taken the focus off the bottom line as investors were expecting the stronger economy to translate into more sales, but that may not be the case this time around.

"At this point earnings are going to be perhaps more important than revenues only because we know Q1 was only a so-so quarter for the economy," said Colas.

"It's not going to be a surprise if revenues are a little bit light. Where we really have to make sure the numbers work is at the earnings level."

BUSY WEEK FOR THE FED

The Federal Reserve could be next week's wild card. Indications of renewed support for loose monetary policy - or the slightest hint in the direction of tightening - have triggered wild moves in the market.

The minutes of the March FOMC meeting are due on Wednesday and market participants will look for insight into the debate regarding the amount and duration of bond purchases the U.S. central bank is executing monthly.

The hawkish argument - a reduction of stimulus - was dented by Friday's job report, so any mention of it in the minutes may not trigger panic. But more than a dozen speeches by various Fed officers next week could stir things up.

The economic reports calendar is light except for consumer data. Retailers are expected to post a 1.9 percent rise in sales for last month, compared with a gain of 2.9 percent in March last year when same-store sales figures are published Thursday.

The Commerce Department posts its own retail sales figures on Friday, followed by the Thomson Reuters/University of Michigan survey of consumers.

They know that the two-story Mall is home to more than 55 shops filled to their brims with furniture, ?paintings, silver, china, quilts, jewelry, Civil War relics, ironworks, lace, primitives, coins, toys, crocks and much, much more.

But it is also a gold mine for those gifted with good taste but burdened with tight budgets, as well as for those who advocate going green ? which, in d?cor-speak, says Greene House Shops Manager Gertrude Cox, translates into the ?repurposing of things.?

When Egypt's satirists poke fun, public prosecutor hits back

The case of Bassem Youssef, the Egyptian satirist accused of insulting Islam and the president, has exposed what seems to be a series of politically motivated investigations into government critics.?

Today prosecutors questioned Ali Qandil, a standup comedian who appeared on the popular political satire show hosted by Egyptian Bassem Youssef. He's accused of insulting Islam during his 20-minute appearance on Mr. Youssef's show, Al Bernameg, or The Program.?

Mr. Youssef himself was interrogated on March 31, over accusations of insulting Islam as well as the president.?A new case has been filed against him as well.?And now Shaimaa Abu El Khir, a journalist who works with The Committee to Protect Journalists, faces accusations?of threatening national security and insulting the judiciary, as does the television host who interviewed her, after?commenting critically on the case against Youssef.

These cases come on the heels of prosecution of?many other local?journalists and prominent opposition activists?in what?critics of the Muslim Brotherhood-backed president, Mohamed Morsi,?say seems?to be a politically motivated campaign against the president's critics by his handpicked public prosecutor.

Activists say the incidents are?further eroding?trust in the public prosecutor's position,?already low because?Morsi appointed the prosecutor himself in a controversial November decree?bypassing the constitutional process.

?We have a big problem with the public prosecutor. He's not independent,? says Ahmed Ezzat, a lawyer who is an activist for freedom of expression and attended Qandil's questioning today. He says the types of cases he is pursuing show where his priorities lie. Complaints of police torture and violence committed by the president's supporters?do not seem to be?pursued with the?same?vigor as cases against the president's opponents.?

The wrong priorities?

The US has been criticized by many Egyptians for not coming down hard enough on the new government for human and civil rights violations, but this string of events seems to have generated concern.?

US Secretary of State John Kerry said yesterday that the US has ?real concerns about the direction that Egypt appears to be moving in," mentioning ?recent arrests? ??likely a?reference?to?Youssef's case. Earlier this week State Department?spokeswoman Victoria Nuland called Youssef's interrogation part of a ?disturbing trend of growing restrictions on the freedom of speech? in Egypt.

The Muslim Brotherhood's Freedom and Justice Party struck back stridently, calling the remarks a ?blatant interference in Egypt?s internal affairs? that ?raise major question marks about the US administration?s position and discourse.? The party said the ?main? complaint against Youssef was defaming Islam, not insulting Morsi.

Morsi's administration released a statement distancing itself from the case against Youssef, saying the prosecutor was acting independently.

&#39;Hard to track, hard to stop&#39;: Unusual bird flu strain kills 4 people in ...

The samples taken from a Chinese man, who passed away in hospital in March, tested positive for H7N9, bringing the death toll of the new strain of bird flu to four people. Scientists warn the virus spreads silently and could be harder to track than H5N1.

A 38-year-old cook fell ill early last month in the Eastern province of Jiangsu, where five other cases of the disease were discovered. The man died in hospital in Hangzhou city on March 27.

There was another case of H7N9 found on Wednesday, with the second patient of 67 years old is currently undergoing treatment also in Hangzhou.
Local Xinhua news agency reports that no connection between the two cases had been discovered and nobody, who was in close contact with either patient had developed any flu-like symptoms.

Human infection cases with the rare bird flu have also been registered in Zhejiang Province, where a man died on April 3, and in Shanghai, where the virus took two lives in March, and Anhui province, where a first case, a 35-year-old woman, was registered. ?

Chinese Xinhua reports very few sick people have been detected, relatively little research has been done on the virus previously known to have infected only birds.

The scientists from research institutes around the world have warned Wednesday that a new strain of bird flu can generate no noticeable symptoms in birds while seriously harming humans.

According to China's National Health and Family Planning Commission, the men who died in Shanghai feel ill with coughs and fevers before developing pneumonia and breathing problems.

However, after taking a first look at the genetics of the H7N9 virus, scientists have come up with a warning: the new virus could be harder to track than H5N1 which started spreading in 2003 and has killed 360 people worldwide since then, according to the WHO.

Chinese authorities are working in contact with the World Health Organization trying to find the source of the human infections, but they could face a challenge in that and then stopping the spread as there is no visible outbreak of dying chickens or birds.


"We still don't know the mode of transmission or host (of the virus),"
Gregory Hartl, WHO spokesman, told Reuters.

"Those are the two most important pieces of information we would need. In order to control it, we need to know where it is coming from." Chinese authorities dismissed speculation on the Internet that the H7N9 outbreak may be related to more than 16,000 pig carcasses found dumped in rivers around Shanghai, with the animal corpses testing negative for the disease.

"In that sense, if this continues to spread throughout China and beyond China, it would be an even bigger problem than with H5N1 in some sense, because with H5N1 you can see evidence of poultry dying, but here you can see this would be more or less a silent virus in poultry species that will occasionally infect humans," AP quoted the University of Hong Kong microbiologist Malik Peiris.

Scientists have so far said there are no signs of transmission of the H7N9 virus between any of the victims or people they have come into close contact with.

However, they still monitor bird flu viruses closely, fearing they may mutate and become easier to spread among humans, possibly sparking a pandemic.

There are no vaccines against the H7N9 bird flu either in China or abroad, but Peiris said that existing anti-flu drugs are likely to work against the H7N9 strain.

Windows QuickStart Kit gives iOS and Mac developers a Microsoftmade testbed

Microsoft knows that many Mac-based developers still have to test in a Windows environment, whether it's to check web rendering in Internet Explorer 10 or to port an iOS or Mac app to competing environments. The firm doesn't want anyone hemming and hawing over how they cross that digital divide, so it's launching a Windows QuickStart Kit in late April to make Windows testing a trivial affair. The USB drive bundle includes a full copy of Windows 8 Pro, virtual machine support through Parallels Desktop 8 and a set of porting labs to help with any app conversions. The lure may may as much about the cost as the convenience: outside of shipping, Microsoft is only asking for a $25 donation to Code.org, the Kahn Academy or Watsi.org. While code builders have to verify their credentials and race to buy from limited stock, the kit could still be one of the easiest (and most charitable) ways to go cross-platform.
