Paralyzed man alleges police shot him in the back

New Jersey man claims police unnecessarily shot him in the back while he was face down on the pavement. WNBC's Marc Santia reports.

A New Jersey man alleges in a federal lawsuit that police shot him in the back, severing his spine, as he lay motionless on the street.

New Brunswick Police officials dispute Victor Rodriguez's account, and say he fired a realistic-seeming starter pistol toward bystanders.

Attorneys for Rodriguez, 19, say he was already shot by police and lying face-down in the street when a second officer shot him in the spine, leaving him confined to a wheelchair for the rest of his life.

According to the lawsuit, Rodriguez was approached by a gang of men who demanded his shoes. Fearing for his life, the lawsuit says, Rodriguez ran across the street and retrieved a starter pistol from his cousin?s backpack and fired two shots into the air.

The crowd dispersed and Rodriguez fled the scene with the starter pistol.

According to the lawsuit, undercover officers were in the area watching.?

As Rodriguez ran past the unmarked police car, the suit contends that the officer behind the wheel opened fire without warning, striking him in the legs.?

Rodriguez was motionless in the street when another officer came around back of the car seconds later and fired a shot into him, according to the lawsuit.

?You?ll then see his two legs reflexively move up and it was at that point we believe he lost the use of his legs,? Rodriguez?s attorney, Alan Zegas, said.

?Police have an obligation to follow the law, not violate it,? Zegas said.

Officials disputed the version of events described in the lawsuit.

Police Director Anthony A. Caputo said in a statement that Rodriguez's starter pistol was modeled after a Beretta handgun, and that he fired "the pistol in the direction of police and city residents."

Through a translator, Rodriguez?s mother, Alejandrina Rodriguez, said that ?all I could think of is, hopefully God will give my son a chance to live to overcome this.?

ECB may have to change tack on bond buys

(AP) ? When European Central Bank head Mario Draghi said that he was ready to "do whatever it takes" to save the euro, he fueled investor hopes the bank would again start buying government bonds to lower borrowing costs for struggling countries.

Just one problem: the ECB has tried bond-buying before. And it didn't work very well ? the action was seen as too hesitant and fell short of decisively lowering borrowing costs for stricken Spain and Italy.

Draghi is certain to face questions Thursday at his news conference after the bank's government council meets about possible bond purchases and the financial turmoil in Europe.

Last week, Draghi noted that excessive government bond interest rates "come within our mandate" if they are hindering the ECB's efforts to spread its single interest rate policy throughout the 17 countries that use the euro. That was seized on as a hint the bank might restart its Securities Market Program that bought bonds in the open market, but which has been left dormant since March.

Bond purchases drive their prices up and their interest rates, or yields, down ? price and yield move in opposite directions. The ECB's earlier purchases were able to temporarily drive down the yields ? and therefore the borrowing costs incurred by Spain and Italy when they floated new bonds.

Analysts say that Draghi has raised expectations for action so high that markets could be sorely disappointed if no new bold measures are announced Thursday. An interest rate cut from the current record low of 0.75 percent remains a possibility, though many analysts think the bank will wait at least until September. Market attention is most intensely focused on what Draghi will say about the bank's willingness to influence the market for government bonds.

Slavena Nazarova, an economist at Credit Agricole expects Draghi to emphasize the bank's willingess to use all its weapons to support the eurozone ? but take no new actions: "We are skeptical that such intervention will come as soon as this week, so there is quite a big risk of disappointment for the markets."

The U.S. Federal Reserve may also leave investors a bit crestfallen, as it considers Wednesday and Thursday whether to do more to stimulate the uncertain economic recovery in the United States. Analysts say it likely will not move to buy more government bonds and stimulate the economy by expanding the supply of money in the economy.

For the ECB, simply re-starting the SMP remains problematic. The bank first used the program in May, 2010 as Greece headed for a bailout, then paused it. It was re-started in August, 2011 as the crisis spread from small countries such as Greece, Ireland and Portugal to countries whose governments are too big to easily bail out ? such as Spain and Italy.

But after an initial dip in yields, Spain and Italy soon saw them rise again. The problem was that ECB said the program had to be limited ? a statement that kept it from overly impressing the bond market.

On top of this, there was opposition from the Bundesbank, Germany's central bank and a high-profile member of the ECB's board. The Bundesbank remains skeptical of bond purchases, saying they come too close to breaking the ECB's founding treaty, which forbids it from financing governments.

Because of the treaty restrictions, the ECB must claim the bond purchases are meant to ensure its ultra-low interest rates are being passed on to all borrowers throughout the eurozone.

It's a restriction not faced by the U.S. Federal Reserve and the Bank of England, both of which have engaged in large-scale bond purchases to expand the supply of money in their economies and try to boost growth.

Here are some other possibilities the bank might look at, all with drawbacks:

? Team up to buy bonds with the eurozone's bailout fund, the European Financial Stability Fund ? or by its replacement, the European Stability Mechanism. The problem is that the EFSF and ESM have limited funding left after bailing out Greece, Ireland and Portugal

? Offer another round of cheap, three-year loans to banks, as the ECB did in December and February. Some of the ?1 trillion taken by banks was used to buy government debt, lowering borrowing costs for several weeks. But banks buying bonds raises the threat that if a country defaults on its bonds, the banking system would be hit. That would hurt credit availability, choking the economy.

? Leave any bond purchases to the EFSF/ESM. The ECB could express willingness to buy the bailout funds' bonds in the open market. That means the ECB could support the effort indirectly.

? Drop the ECB's insistence on being paid in full on any of the bonds it owns in case a country defaults. Such ECB "seniority" could make investors afraid they would be behind the bank in the line to get paid back ? and lead them to demand higher yields on a country's bonds. That's the opposite of what the ECB would be trying to achieve. But if the ECB makes a loss on their bonds, that's passed back to the governments that finance it.

"A reactivation of the SMP only makes sense if other measures are decided on," such as dropping the bank's preferred creditor status, said Christoph Balz, analyst at Commerzbank. He warned that dropping that "seniority" status could create new problems. Any ECB losses would be passed back to national governments as part of the bank's profit or loss for the year. That means losses on Spain could hit troubled Italy, for instance.

Such a change "is not so easy to do," Balz said. "This argues for Draghi likely not making any announcement this week of any big program to buy bonds," said Balz.

Sports Psychologists Extend Their Counseling to Athletes' Coaches and Families

The crowd has quieted, but an electric energy from the packed grandstands fills the air. The diver stands atop the platform, aware of television cameras below that are broadcasting his every muscle twitch to millions of viewers worldwide. He can smell the chlorine wafting up from the diving pool 10 meters below. The texture of the platform feels rough beneath his feet. He takes a breath, makes his approach and jumps sharply upward. Then he twists through the air, executing a perfect dive and, finally, with no more than a few drops of splash, knifes smoothly into the cool water.

The diver opens his eyes. Feeling confident and relaxed, he now looks ahead at the platform and gets ready to climb the familiar ladder to make his practice dive before the actual competition, still weeks down the road.

This diver had just gone through one of his most important workouts before he actually stands up on the Olympic diving platform: visualization. Olympic divers, such as David Boudia and Thomas Finchum, as well as other top athletes, use trusted psychological tactics such as visualization and positive self-talk to stay at the top of their games?even when the pressure is on. Yet the sports psychologists who teach these techniques now have more scientific results in hand, and they are learning that the athlete's mental tools are just the jumping-off point to achieving peerless performance. Giving an athlete or team the best chance of bringing home the gold also requires creating an entire environment of carefully constructed group and interpersonal dynamics. Sports psychologists are no longer just training athletes. They are also training the coaches and family members in the competitors' lives.

"We've learned a lot in the past 10 or 15 years about how to be more effective" in teaching everyone around an athlete how to help him or her excel, says Daniel Gould, professor of applied sports psychology at Michigan State University. And the athletes say the work is paying off.

Getting inside the coach's head
Even an athlete in the most individual of sports is part of a complex network of relationships. Coach, family, friends, even team administrators are an extensive and often under-recognized part of the experience. Elite athletes might be better than the average person at shutting out distractions, managing their emotions and controlling their energy levels. But they are not immune to an overbearing parent, negative coach or unsupportive teammate.

Coaches and support staff, whether they realize it or not, are creating a mental environment for athletes, not just a physical training regimen. And although sports psychologists are often deployed for the benefit of the athletes, "a lot of times we work through the coach because the coach is creating a psychological climate," Gould says.

Counselors are achieving "a huge gain in better educating our coaches," Gould continues. By the time an athlete reaches college or professional levels, coaches are almost operating like CEOs, Gould notes. They're in charge of coordinating a huge organization of specialists?athletes, nutritionists, strength coaches, media liaisons and psychologists. So to gain access to athletes, physically and mentally, a sports psychologist must first be accepted and supported by the coach. Then the expert can start working to help the coach maintain a productive, balanced emotional arena for the athletes. Gould describes this environment as a fine balance of autonomy?individually empowered athletes and staff?and connectivity, essentially a feeling of relatedness among the entire group. "That's pretty easy to say," Gould says. But helping coaches and teams achieve that state is no small task. Especially when everyone is under extreme stress of high-level competition.

National Flood Insurance Program intact for next 5 years according ...

Thanks to the hard work of our levee districts, Fort Bend County Judge Robert Hebert, Senator John Cornyn, Congressman Pete Olson and the Fort Bend Flood Management Association (FBFMA), our national flood insurance program is intact for the next five years. These individuals and groups have been hard at work behind the scenes to save our flood insurance program.

Congress has been trying to revamp the National Flood Insurance Program (NFIP). Although our Districts supported these efforts, the Senate pushed hard to include a provision that required the purchase of mandatory flood insurance at very high rates and ignored the healthy levees our local tax dollars built and maintain. We believe this mandate would have imposed a financial hardship on our taxpayers and would have negatively affected our home values.

Our levee districts worked under strong leadership provided by Fort Bend County Judge Robert Hebert and the FBFMA with Senator Cornyn and Congressman Olson to defeat this unreasonable mandatory provision. The House and Senate passed a transportation bill that helped us on this critical matter. This bill included an extension of the NFIP without the mandatory purchase requirement that ignored our healthy levees. Judge Hebert provided great leadership and the lobby teams hired by Fort Bend County and the FBFMA helped our Districts explain the adverse impact of bad legislation that was introduced to revamp the NFIP. Senator Cornyn helped us fight the battle in the Senate. Congressman Olson worked behind the scenes as a member of the Majority Whip team in the House and with Senate allies to make sure the transportation bill passed with good language and to defeat the bad legislation that would have required the mandatory expensive insurance. At least for now, our taxpayers do not have to worry about skyrocketing flood insurance premiums mandated by the federal government.

Thanks to our County and federal leadership for looking after our taxpayers. Your leadership was instrumental in protecting our quality of life.
